TERMS AND CONDITIONS

These Terms and Conditions define the rules for concluding and performing a service agreement for the preparation and delivery of a property owner's declaration of consent to designate their address as the place of potential eviction of the tenant – within the framework of an occasional rental agreement concluded by the Client – via the website najemokazjonalny.com.pl.

§ 1 GENERAL PROVISIONS

1. These Terms and Conditions define the rules for the provision of electronic services by the Company to Clients using the website najemokazjonalny.com.pl (hereinafter: "the Website").

2. Before placing an order, the Client is required to read these Terms and Conditions and the Privacy Policy available at najemokazjonalny.com.pl/en/privacy.

3. Placing an order constitutes acceptance of these Terms and Conditions and conclusion of a service agreement under the terms specified herein.

4. The Terms and Conditions are made available free of charge on the Website in a manner that allows downloading, saving, and printing.

5. The Service Provider provides services within the territory of the Republic of Poland.

§ 2 DEFINITIONS

The terms used in these Terms and Conditions shall have the following meanings:

1. Company / Service Provider – Efis Group Sp. z o.o. with its registered office in Szczecin, ul. Mazurska 45/6, 70-424 Szczecin, KRS 0001078313, NIP 8513304809, REGON 527305757.

2. Client – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality that places an order via the Website.

3. Consumer – a Client who is a natural person performing a legal act not directly related to their business or professional activity (Article 22¹ of the Polish Civil Code).

4. Service – the preparation and delivery of a document containing the property owner's declaration of consent for the tenant to reside at the indicated address in the event of enforcement of the obligation to vacate the premises (in accordance with Article 19a(2)(2) of the Act on the Protection of Tenants' Rights).

5. Website – the online service operated by the Company, available at najemokazjonalny.com.pl.

6. Order Form – an interactive form available on the Website that enables the Client to provide the data necessary for the performance of the Service and to place an order.

7. Order – the Client's declaration of intent made through the Order Form, aimed at concluding a service agreement with the Company.

8. Business Day – every day from Monday to Friday, excluding public holidays in the Republic of Poland.

§ 3 TECHNICAL REQUIREMENTS

1. To use the Website, the following are required:

a) a device with Internet access (computer, tablet, or smartphone),

b) a web browser in its current version (Google Chrome, Mozilla Firefox, Safari, Microsoft Edge),

c) an active e-mail account,

d) cookies and JavaScript enabled in the browser.

2. To open the document delivered in PDF format, software supporting this format is required (e.g., Adobe Acrobat Reader).

3. The Service Provider is not responsible for technical issues arising from the Client's failure to meet the above requirements.

§ 4 PLACING AN ORDER

1. Orders are placed via the Order Form available on the Website. The order process includes the following steps:

a) selecting the type of service (declaration with electronic signature or notarial signature),

b) filling in the form with data necessary for the performance of the Service, including: personal data of the tenant and property owner, address of the rented premises, address of the premises designated for eviction, date and duration of the rental agreement, contact details,

c) reading the Terms and Conditions and accepting them by checking the appropriate box,

d) verifying the accuracy of the entered data in the order summary,

e) clicking the "Order and Pay" button, which constitutes placing an order with an obligation to pay,

f) making payment using the selected method.

2. After placing an order, the Client receives an order confirmation at the provided e-mail address, containing the order number, data summary, and information about further steps.

3. The service agreement is concluded upon confirmation of the order by the Company.

4. The Client is obliged to provide truthful and complete data in the Order Form. The Company is not responsible for the consequences of providing false or incomplete data.

§ 5 PRICES AND PAYMENTS

1. Service prices listed on the Website are gross prices (including VAT) and are expressed in Polish zlotys (PLN).

2. The price indicated for a given Service at the time of placing the order is binding for both parties.

3. Payment for the Service may be made:

a) by bank transfer to the Company's account indicated in the order confirmation,

b) via the Przelewy24 online payment system operated by PayPro S.A. based in Poznań (ul. Pastelowa 8, 60-198 Poznań, KRS 0000347935, NIP 7792369887).

4. In the case of bank transfer payment, the Client is obliged to make the payment within 3 business days from the date of placing the order. Failure to pay within this period results in cancellation of the order.

5. Upon the Client's request, the Company issues a VAT invoice. To receive an invoice, the Client should provide the invoice details in the Order Form or request it by e-mail at kontakt@najemokazjonalny.com.pl.

§ 6 SERVICE DELIVERY AND DELIVERY TIME

1. Service delivery begins after the payment has been credited and the Client has provided all the data necessary for the preparation of the document.

2. The Company prepares the document and delivers it to the Client within the following timeframes:

a) Electronic document (PDF with electronic signature) – sent to the Client's e-mail address within 24 business hours from the moment the payment is credited and complete data is received.

b) Document with notarial signature – shipped via courier or to a parcel locker within 2 business days from the preparation of the document. The delivery time is an additional 1–3 business days depending on the chosen delivery method and delivery address.

3. If the Client has provided incomplete or incorrect data, the Company will contact the Client to request corrections. The service delivery period runs from the moment complete and correct data is received.

4. The Company reserves the right to extend the delivery period in exceptional cases, about which the Client will be informed by e-mail.

§ 7 RIGHT OF WITHDRAWAL

1. A Consumer who has concluded a distance contract has the right to withdraw from it without giving any reason within 14 days from the date of conclusion of the contract, in accordance with the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827, as amended).

2. To exercise the right of withdrawal, the Consumer should submit an unambiguous statement of withdrawal from the contract. The statement may be submitted:

a) by e-mail to: kontakt@najemokazjonalny.com.pl,

b) by post to: Efis Group Sp. z o.o., ul. Mazurska 45/6, 70-424 Szczecin, Poland.

3. Sample withdrawal statement:

"I, [full name], hereby inform you of my withdrawal from the service agreement for the preparation of a property owner's declaration, ordered on [order date], order number: [number].

Full name: _______________

Address: _______________

Date: _______________

Signature (if the form is in paper version): _______________"

4. In the event of effective withdrawal from the contract, the Company shall refund all payments received from the Consumer without delay, no later than within 14 days from the date of receipt of the withdrawal statement. The refund is made using the same payment method used by the Consumer, unless the Consumer has agreed to a different method of refund.

5. Loss of the right of withdrawal: The right of withdrawal does not apply to the Consumer if the Company has fully performed the Service with the Consumer's express and prior consent, and the Consumer was informed before the commencement of the service that after its completion by the Company, they would lose the right of withdrawal (Article 38(1) of the Consumer Rights Act).

6. Before placing the order, the Consumer is informed about the possible loss of the right of withdrawal and asked to consent to the commencement of the service before the expiry of the withdrawal period.

§ 8 COMPLAINTS

1. The Client has the right to file a complaint regarding the Service provided by the Company.

2. Complaints should be submitted:

a) by e-mail to: kontakt@najemokazjonalny.com.pl,

b) by post to: Efis Group Sp. z o.o., ul. Mazurska 45/6, 70-424 Szczecin, Poland.

3. A complaint should include:

a) the Client's full name,

b) e-mail address or postal address,

c) order number and date of order,

d) a detailed description of the problem constituting the basis of the complaint,

e) the expected method of resolution.

4. The Company shall review the complaint and provide a response within 14 days from the date of its receipt. The response is sent to the e-mail address or postal address provided in the complaint.

5. If the complaint does not contain the data necessary for its review, the Company will ask the Client to provide the missing information.

§ 9 LIABILITY

1. The Company shall make every effort to ensure that the Website operates continuously and without interruptions. However, the Company is not liable for temporary disruptions in access to the Website caused by maintenance, updates, or force majeure.

2. The Company is not liable for consequences arising from the Client providing false, incomplete, or outdated data in the Order Form.

3. The document prepared by the Company is informational in nature and does not constitute legal advice. The Company recommends consulting a lawyer or notary in case of doubts regarding the Client's legal situation.

4. The Company is not liable for actions or omissions of third parties, including payment operators, postal service providers, and couriers.

§ 10 PERSONAL DATA

1. The controller of the Client's personal data is Efis Group Sp. z o.o. with its registered office in Szczecin, ul. Mazurska 45/6, 70-424 Szczecin.

2. Personal data is processed for the purpose of order fulfillment, contract performance, fulfillment of legal obligations, and – with the Client's consent – for marketing purposes.

3. The Client has the right to:

a) access their personal data,

b) rectification of data,

c) erasure of data ("right to be forgotten"),

d) restriction of processing,

e) data portability,

f) object to processing,

g) lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, Poland).

4. Detailed information regarding the processing of personal data is contained in the Privacy Policy.

§ 11 OUT-OF-COURT DISPUTE RESOLUTION

1. The Consumer has the option of using out-of-court methods of complaint resolution and claim pursuit, including:

a) submitting a request for dispute resolution to a permanent consumer arbitration court operating at the Trade Inspection,

b) applying to the Provincial Inspector of Trade Inspection for the initiation of mediation proceedings for the amicable settlement of the dispute,

c) seeking assistance from a county (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.

2. The Consumer may also use the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr. The platform serves to resolve disputes between consumers and entrepreneurs electronically.

§ 12 FINAL PROVISIONS

1. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, and the Act on Providing Electronic Services.

2. These Terms and Conditions are effective as of 1 March 2026.

3. The Company reserves the right to amend the Terms and Conditions for important reasons, such as changes in legislation, changes in the Service offer, or technological changes. The amended Terms and Conditions shall take effect from the moment of their publication on the Website.

4. Orders placed before the effective date of changes to the Terms and Conditions shall be processed under the previous provisions.

5. Any disputes between the Company and a Client who is not a Consumer shall be resolved by the court having jurisdiction over the Company's registered office. In the case of disputes with a Consumer, the competent court shall be determined in accordance with the provisions of the Code of Civil Procedure.
